Ok, I'll add a check in this function to be sure there is something selected.
You have a problem in your code:
$('testpic').nyroModal();
should be
$('#testpic').nyroModal();
(you're not with prototype here ;))

Thanks for your help. I know I need to change my library away from prototype but it's going to be a major process :-). Is there anything I can do in the mean while to avoid the above error? Thanks for you help.

YYou have to use jQuery in order to user nyroModal. To do so, you can use jQuery in the noConflict mode, nyroModal will continue to work. http://docs.jquery.com/Core/jQuery.noConflict

I released the version 1.2.7 which return false in $.nyroModal if there is nothing selected
