Affected Version: 2.9-rc2-598-g1be3d51

Seems like the state of our gerrit repo is stuck in a weird state

What steps will reproduce the problem?
1. From origin/master, touch a new, dummy file and commit it
2. Push to gerrit

What is the expected output? What do you see instead?

Since it is a new file, there shouldn't be any conflicts. However, we see the red "Cannot Merge" warning with no option to rebase. We can still give ourselves a +2 and submit the change just fine. 

Please provide any additional information below.
