I've added the following source
2493 unselectable: $li.hasClass("unselectable"),
2494 hideCheckbox: $li.hasClass("hideCheckbox")
so you can still generate the tree from ul/li construct, but still have all options available... maybe all options should be available.

I second that, data attributes are much better...
Also don't forget a data-key. I'm using dynatree for multiple trees on one page where the trees have the same content (it's for selecting reference1 and reference2).
Now the li's need to have the same id, which although not allowed, works without problems $('#tree1 #ref203') works just fine, but I would prefer unique id's and the key value using a data attribute

As of 2014 Dynatree is feature frozen. Please have a look at Fancytree (sequel of DynaTree 1.x): chances are good that the problem was resolved / the requested featuer is already implemented. Please open a new issue there otherwise: https://github.com/mar10/fancytree
